Maharashtra State Electricity Distribution Company Ltd. (MSEDCL) & Anr.
....Respondents Mr.Ajay Deshpande with MR.Amol Gatne for Petitioner. Mr.P.. Chavan with Kiran Gandhi I/b. Little & Co. for Respondents. CORAM : ANOOP V. MOHTA & S.C. GUPTE, JJ.
11 MARCH 2016 P.C. :
Rule, returnable forthwith. Heard learned Counsel for the parties. The grievance of the petitioner is that the Respondents are not providing the requisite documents, which are necessary in defence of his case, in view of the charges specifically made. The grievance is also that parallel departmental proceedings are initiated in spite of pendency of prosecution. Learned Counsel for the Respondents makes a statement that those documents are not privileged documents. Considering the facts and circumstances, at this stage, we are inclined to direct the Respondents to provide the necessary documents, as prayed, as early as possible, preferably within three weeks. The Petitioner to file a reply to the show cause notice / charge-sheet dated 26 November 2015. The Respondents to consider the same in reply in accordance with law. The petition is disposed of with liberty. All points are kept open. No costs.
