This petition under Article 227 of the Constitution of India seeks to challenge the Judgment and Order dated 21st November 2017 in Miscellaneous Civil Appeal No. 127 of 2015 passed by the learned District Judge - 9, Nashik. The said order is in force till today.

Mr. Sathaye, learned Advocate for the Petitioner fairly states that since the suit has riped for hearing, interest of justice will be met if the Trial Court is directed to decide the suit on merits. He states Digitally signed by ATUL GANESH KULKARNI Date:

It is made clear that the order dated 21st November 2017 shall remain in force during the pendency of the suit. It is also made clear that the Trial Court shall decide the suit on merits without being influenced by the observations made in the impugned order. 4.
Writ Petition is disposed of in above terms.
