By the impugned order the learned Judge has declined to take on record the list of witnesses and allow the petitioner to record the evidence of the witness Anil Kashinath Pawar. 2.

The records indicate that after the evidence was concluded, the Petitioner had filed application stating that she wanted to examine her Uncle. However, it is stated that the list of witnesses was not annexed to the Application.

Learned Judge has dismissed the application and rejected the prayer to allow the Petitioner to record the evidence of her uncle, mainly on the ground that the list of witnesses was not filed. 4.

Respondent No.2 has stated that he has no objection if the Petitioner is allowed to examine the witnesses. IN the light of the said statement, and also in the interest of justice the impugned order is set Salgaonkar

47 WP 3337-22.doc aside. The Petitioner is directed to examine witness Anil Pawar. 5.

Petition is accordingly disposed of.
