ORAL ORDER :(Per Mrs. M.R. Bhatkar J.) The petitioner has filed an application dated 8th February, 2014 from Kolhapur Central Prison, Kalamb stating that he has been convicted for 7 years for the offences punishable under sections 395, 397 of Indian Penal Code. He has also stated that he did not file any Appeal because he did not have money. Hence, he prayed that he be given a benefit under Probation of Offenders Act, 1958.

On perusal of record, it is found that after this Application, the petitioner Datta Tonpe has filed Criminal Appeal No. 564 of 2014 and he was granted bail by an order dated 11th July, 2014. Thus, today the

903.WP997_2014 petitioner is on bail, which was granted after filing of this Writ Petition. 3.

In view of this, the petition has become infructuous and hence dismissed.
