The Applicant, apprehending arrest, in connection with investigation of Crime No.28/2022 of Police Station Kharghar, Mamta Kale page 1 of 3
Navi Mumbai, under Section 354, 354-A, 500, 501 and 506 of IPC, is seeking anticipatory bail.

I have heard the learned counsel for the Applicant and the learned APP assisted by the learned counsel for the Respondent / Complainant. I have also perused the FIR. Considering the nature of the allegations made, in my opinion would not require any custodial interrogation. In so far as the mobile phone of the Applicant is concerned, in the earlier order passed by this Court, when the main Application was pending before the learned Sessions Judge, the Applicant was directed to surrender the mobile, if required.

The learned APP states that the Applicant has failed to surrender the mobile phone.

The learned counsel for the Applicant states that the mobile has been lost and the complaint to that effect has been filed with the concerned Police Station. The learned counsel for the Applicant submits that the Applicant will furnish his mobile number and IMEI number to the Investigating Officer in order to enable the Investigating Officer to investigate the matter further.

In the circumstances, the following order is passed.
ORDER
(i) In the event of his arrest, in connection with investigation of Crime No.28/2022 of Police Station Kharghar, Navi Mumbai, the Applicant Shankar Kacharu Thakur, be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties, in the like amount. (ii) The Applicant shall report to the Investigating Officer, as and when required and shall cooperate with the Investigating Agency. (iii) The Applicant shall furnish his mobile number and IMEI number to the Investigating Officer.
(iv) The Criminal Application is disposed of, in the aforesaid terms.
(v) The Interim Application also stands disposed of.
