1] This petition challenges the order dated 4th January 2016 by which the Additional Commissioner, Pune Division dismissed the application for interim relief filed by the petitioner in his appeal, preferred against the order of his disqualification under sections 14(1)(g) and 16 of Bombay Village Panchayat Act, 1958. By the order dated 20th December 2015, the Additional Collector Kolhapur allowed the objection of respondent Nos. 4 and 5 and held the petitioner disqualified under sections 14(1)(g) and 16 of the Bombay Village Panchayat Act, on the ground that after being elected as a Member of Panchayat, he had continued to carry out the work for the panchayat and received an
YBG 903-wp3115-16 amount of Rs.8790/- on 7th September 2015 by cheque bearing No.420859. The refusal of the interim relief to the petitioner is on the very ground. There is no dispute that the petitioner had received an amount from Grampanchayat after his election. Since this fact is not disputed, there can be no interference with the impugned order. 2] Hence, the petition is dismissed.
