Affidavit of service to that effect is filed by the applicant. Despite service of notice of this civil application, none appears on behalf of the respondent.

The averments made in paragraph 3 to 6 are deemed to be accepted by the respondent. In that view of the matter, civil application is allowed in terms of prayer clause (a). Consequently, 2 days delay in filing the appeal is condoned. 5.

Registry is directed to number the appeal and place it for admission on 2nd July, 2015.
