P.C. :
The petitioner is before us as a project affected person complaining that out of total entitled area of 1 Hector and 20 Ares, only the land admeasuring 60 Ares has been allotted to the petitioner in the year 2011. The petitioner contends that the balance land of 60 Ares, which is still to be allotted to the petitioner, is not allotted in spite of several letters and representations. It is seen from the record that the land of the petitioner was acquired in the year 1992 and the alternate land in terms of the scheme was to be granted. However, partial land has been granted to the petitioner and the
skn 2/2 8084.16-wp.sxw balance land of 60 Ares is yet to be granted. According to the petitioner, he has shifted to village- Patgaon, Taluka Bhudargad, district- Kolhapur. He has sought for allotment of land near Gargoti. However, the same is not yet considered. According to the petitioner, he has also identified the land being Gat Nos.424/A and 191/B situated at village- Terwad. Both the lands are in the Kolhapur district.
2.
If the petitioner is entitled to a land of 1 Hector 20 Ares and when the land of 60 Ares has already been granted to him, we find no reason why the authorities are keeping the matter pending though the petitioner has lost his land in the year 1992. In that view of the matter, respondent Nos.2 and 3 are directed to treat this petition as representation of the petitioner and consider the averments made therein along with other annexures and dispose it of in accordance with the procedure contemplated, within three months from the date of receipt of copy of this order. 3.
With the aforesaid direction, the petition is disposed of. (M.S.SONAK, J.) CHIEF JUSTICE
