Heard the learned counsel for the applicant and the learned APP for the State.

The learned counsel for the applicant submits that the first application came to be dismissed by this Court by an order dated 13th April, 2023. However, there has not been any progress in the trial.

Since the first application was dismissed on merits, there is no propriety in entertaining this application.

In the aforesaid view of the matter the learned counsel for the applicant, on instructions, seeks leave to withdraw the application. The learned counsel submits that the trial be expedited as the applicant has been in custody since 5th June, 2020. 5.

Having regard to the period of incarceration, the prayer for expeditious conclusion of the trial seems justifiable. The Court is Vishal Parekar ...1

The learned Session Judge seized with the Session Case No. 356 of 2020 is requested to make an endeavour to commence and conclude the trial in Session Case No. 356 of 2020 within a period of nine months from the date of communication of this order. 7.

In the event, the trial is not concluded within the said period, the applicant shall have the liberty to revive the prayer for bail. Application disposed.
