Parties have settled their dispute in the Lower Court, i.e., MACT, Pune. The First Appeal is by the driver of the vehicle involved in the accident. The Claimant has accepted an amount of Rs.35,000/-, which the Appellant has agreed to and has in fact paid. 2.

The Appeal does not survive and is, therefore, dismissed as infructuous along with the Civil Application. 3.

A copy of the Consent Terms tendered by the parties before the Trial Court and marked "Exhibit-19" in that Court is taken on record and marked "X" for identification.
