The learned counsel for the Applicant submits that this Court (Coram : V.G. Bisht, J.) by order dated 28th October 2021 has granted bail to the Applicant. While granting bail, this Court has imposed condition on Applicant to attend the concerned Police Station once in three months on first Saturday of every calendar month between 11.00 a.m. to 1.00 p.m. till further orders.

The learned counsel further submits that, the Applicant is resident of Mumbai. The Trial Court has kept the matter for framing of charge. Since from several dates charge has not framed. It is very difficult for the Applicant to attend the concerned Police Station i.e. at Pune in every three months. Hence, requested to allow the Application by relaxing the said condition.

The learned APP strongly objected to allow the Application on the ground if the said condition be relaxed the Applicant may abscond.

I have heard both learned counsel.

Admittedly, matter is kept for framing charge. The pass-port of the Applicant is already deposited before the Trial Court. Hence, no question arise of absconding of the Applicant. The matter is kept for framing of charge before the Trial Court. N.S. Kamble page 2 of 3
