This Application is made by the claimant for condonation of 173 days delay in preferring the appeal challenging the award dated 20/06/2013 passed by the MACT Mumbai in Application No.2520/2004 for additional compensation.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) Civil Application is allowed in terms of prayer clause (a) which read thus:

(a) That the delay of 173 days in filing the appeal be condoned.
