CORAM :

NITIN W. SAMBRE, J.

DATE:

JULY 6, 2021.

P.C.:

1] Applicant is seeking pre-arrest bail in C.R. No. 43/2019 registered with Versova Police Station for Offences punishable under Sections 153(a), 506(II), 500 of the Indian Penal Code. 2] The submissions are, perusal of F.I.R. does not depict prima facie involvement of the accused and the necessary ingredients of the offences for which the applicant is booked cannot be inferred. 1/2

22.541.19 aba.doc 3] With the assistance of learned APP, I have perused the contents of F.I.R.

4] Apart from criminal antecedents, there is suffcient material to infer prima facie involvement of applicant in the crime in question. 5] The Court needs to be sensitive to the circumstances in which the applicant has tried to create communal hatred thereby trying to disturb the law and order situation. As the applicant's prima facie involvement can be inferred, no case for grant of pre-arrest bail is made out.

6] Application fails, stands rejected.
