On the last date i.e. on 22.9.2015 it was stated that the appellant Shankar Awatade had expired, hence, we had asked the learned A.P.P. to verify this fact. The report of the Assistant Police Inspector, Velapur Police Station, Solapur Rural and the annexures thereto submitted by the A.P.P. shows that the appellant expired on 26.10.2011 due to cancer. The said report along with annexures including death certificate, is taken on record and marked `X' collectively for identification. In view of the above, the appeal abates and is disposed of as such.
