Heard learned counsel for the applicant.

By this application, the Applicant seeks modification/relaxation of the condition imposed by this Court (Coram:A.S.Gadkari,J.) vide order dated 16th February, 2018, passed in Criminal Bail Application No.320 of 2018.

Learned Counsel for the applicant submits that the applicant being a resident of Gujarat is unable to get local sureties, as directed by this Court vide order dated 16th February, 2018. Learned Counsel for the applicant also seeks cash bail for the said amount, for a period of four weeks.

Perused the papers. The condition of which modification/relaxation is sought, reads thus:- "5.

a) The applicant be released on bail in C.R.No.430/2017 dated 18.10.2017 registered with MIDC Police Station, Mumbai (now culminated into Sessions Case No.2/2018) on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount." 5.
The applicant is a resident of Gujarat and is pursuing his studies in M.C.A. Degree from Gujarat University. The applicant despite having been enlarged on bail vide order dated 16th February, 2018, continues to languish in jail, as he is unable to get one or two solvent
3/4 local sureties in the like amount of Rs.25,000/-. 6.
Considering the peculiar facts of this case, the application is allowed and the condition (a) of para 5, imposed by this Court vide order dated 16th February, 2018, stands modified, as under:-
ORDER
(i) The applicant shall now be released on bail in C.R.No.430/2017 dated 18.10.2017 registered with MIDC Police Station, Mumbai (now culminated into Sessions Case No.2/2018) on his furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount; (ii) The Applicant be released on cash bail in the sum of Rs.25,000/-, for a period of four weeks;
(iii) The Applicant shall within the said period of four weeks, furnish P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

The Application is allowed and disposed of in above terms. Rest of the conditions imposed vide order dated 16th February, 2018, to remain as it is.
