CORAM : M.S.SONAK, J.

DATE : APRIL 1, 2019 P.C.:- After the matter was argued for some time, Mr.Kantawala, learned counsel for the applicant, on instructions from the applicant, seeks leave to withdraw the application with liberty to pursue L.C. Suit No.670/2014 and requests that the ad-interim relief granted in this application be continued for a period of two weeks from today. 2.

Although, the request for continuation of ad-interim protection is opposed by learned counsel Ms.Bane for respondent No.1, in the facts of the present case, the said protection can always be extended.

However, it is made clear that such extension is not on merits and, therefore, should not in any manner influence the trial

3.

Accordingly, leave is granted to withdraw the application with liberty as prayed for. However, it is made clear that all contentions of the parties are kept technically open so that there is no occasion to interpret the liberty granted by this Court in any particular manner. 4.

The petition is disposed of in the aforesaid terms. 5.

Ad-interim protection granted on March 12, 2019 however to continue up to April 24, 2019.
