Petitioner has already filed Civil Suit bearing Regular Civil Suit No.50 of 2020 before Civil Court at Pandharpur. Application for temporary injunction is rejected. 3.

In the Civil Suit, Petitioner has claimed the similar relief as claimed in the present Writ Petition. Petitioner cannot prosecute both the proceedings at one and the same time. In case, application for temporary injunction of the Petitioner is rejected, petitioner has remedy of appeal against the same.

As the Civil Suit is already filed and the Civil Judge is seized of the matter, it would be inappropriate to entertain the Writ Petition.
