2] Prayer for adjournment moved by the Counsel for non-applicant is opposed by the Counsel for the Applicant.

3] It is informed that, earlier, attempt of mediation was not materialized.

4] Transfer is sought on the following grounds viz (a) hardship will be caused to the Applicant, as distance between the two places is about 150 kilometers one way, (b) two proceedings are already pending at Pune; one initiated in the form of D.V. Act proceedings and another, questioning the order granting maintenance under D.V. Act by non-applicant/husband before the Sessions Court. 1/2

44. MCA-131-2019.doc 5] In the aforesaid backdrop, submissions of learned Counsel for the non-applicant are, transfer is not warranted keeping in mind the cause as narrated in the proceedings of which transfer is sought. 6] I have considered the submissions.

7] Apart from the fact that two proceedings are pending at Pune as referred to above, Applicant'

s convenience is also required to be looked into as she is required to travel to attend the proceedings. 8] In that view of the matter, Application is allowed in terms of prayer clause (a). Prayer clause (a) reads as under:- "(a) the records and proceedings of Marriage Petition (M.H.P.) No. 8 of 2019 which is pending before the Ld. C.J.S.D., Alibaug, Dist: Raigad be transferred to the Ld. Family Court, Pune;"

9] Parties agree that they shall appear before the Court below in transferred proceedings on 9/3/2022. Court below is requested to make it convenient to parties by posting all the three matters on the same date.

10] Application is disposed of.
