Heard the learned counsel for the parties.
Revision Application be registered according to the order passed in the criminal application no. 106 of 2015. The Applicant (accused) has been convicted for the offence punishable under section 138 of the Negotiable Instruments Act and is sentenced to suffer simple imprisonment for one month and to pay a fine of Rs. 1,30,000/-, in default to Borey 1/2
spb/ 2prrevnst105-15.doc suffer simple imprisonment for 10 days. His Appeal has been dismissed by the Appellate Cort. Hence, this revision application.
The Applicant (accused) and Respondent No.2 (complainant) are present in the court. It is submitted by Respondent No. 2 that he has received the amount from the applicant as per the settlement and he has no grievance against the applicant. It is prayed on behalf of the applicant that in view of the amicable settlement of the dispute, the offence may be treated to be compounded.
Prayer is granted. The offence punishable under section 138 of the Negotiable Instruments Act shall be deemed to have been compounded. The Applicant is acquitted of the said offence. His bail bond, if any, shall stands cancelled. Revision application stands disposed of accordingly. (JUDGE) .....
