The above Civil Application has been filed for restoration of the above First Appeal which has stood dismissed for non prosecution in view of the conditional order passed by the Learned Registrar Judicial of this Court dated 3-1-2013 in view of the non removal of the office objection relating to the Respondent No.2. The Applicant State has already filed Civil Application No.3880 of 2013 for bringing the heirs of the Respondent No.2 on record. In view thereof, the above Civil Application No.3878 of 2013 is allowed, resultantly the order dated 3-1-2013 is set aside and the above First Appeal is accordingly restored to file.
