This is an application for anticipatory bail in connection with C.R.No.163 of 2021, registered with Valiv Police Station, for the ofences punishable under Section407 read with 34 of Indian Penal Code.

The case of the prosecution is that iron rods were entrusted to the co-accused Radhesham Ramlakhan. The goods were transported through the vehicle. In between, the iron rods

It is the case of the prosecution that the applicants were involved in ofoading and aiding and abetting the co-accused in commission of the ofence. Learned counsel for the applicant submitted that their custodial interrogation of applicants not necessary. Applicant no.1 is already arrested. Hence, his application has become infrucutous. Entrustment of goods were made by the coaccused. The goods are already seized. The applicant need not be subjected to custodial interrogation.

On perusal of FIR and the investigation conducted by the investigating oficer, it is apparent that applicant nos.2 and 3 have participated in ofence. Apart from the iron rods which were entrusted to the complainant, it was found that huge quantity of iron rods were also recovered from the place where the iron rods were ofoaded by the co-accused. In the circumstances, no case for grant of anticipatory bail is made out. Hence, application is rejected.
