This application has been taken out in petition which has been admitted on 19th November, 2005. During the pendency of the petition, the sole Respondent Mr. Sarjerao Dharu Chavan passed away on 26th February, 2008. 2.

The application seeks to bring on record the legal heirs and representatives of the sole respondent to be added as party respondents to the accompanying petition.

Learned counsel appearing for the Respondents has no objection at this V.A. Tikam 1/2

For the reasons stated in paragraphs 3 and 4 of the application, the delay, if any, in taking out the present application is condoned and the abatement, if any, is also set aside. Civil application is allowed in terms of prayer clauses (a) and (b).

Amendment to be carried out within two weeks from today. Amended copy of the petition to be served upon the newly added Respondents immediately thereafter.
