IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION Writ Petition NO. 2709 OF 2005 Radhabai Krishna Shinde

...Petitioner

Versus

Narayan Govind Date And Ors.

...Respondents

Mr.Nitin P. Deshpande, for the Petitioner.

Mr.Mandar Limaye, for Respondent Nos.1 and 2. --- CORAM : G.S.KULKARNI, J.

DATE : 9 February 2018 P.C. :

Not on board. Taken on board.

1.

By an order passed by this Court on 7 February 2018, this petition was to be listed today for the limited purpose of compliance of the statement made by Mr.Deshpande, learned Counsel for the petitioner to place on record an affidavit of respondent no.1 furnishing the details of Pan Card and Aadhar Card. Accordingly, Mr.Limaye and Mr.Deshpande have placed on record an affidavit of respondent no.1 annexing to the affidavit a copy of Aadhar Card and Pan Card. In the affidavit, respondent no.1-Narayan Govind Date has confirmed that the writ petition is settled and he has signed the consent terms as also that he was present in the Court. Mr.Limaye, learned Counsel for respondent no.1 states that he has also examined the originals of the

Pvr 2/2 wp2709-05.doc Aadhar Card and Pan Card and that the copies which are annexed are true copies of the same.

2.

Thus, in view of the entire exercise as undertaken and noted in the order dated 7 February 2018, it is clear that the parties have freely consented to resolve the dispute in terms of the consent terms and that there is no dispute whatsoever on the terms of the settlement as also in regard to the contents of the consent terms and the signatures thereon. This finally also ends the anxiety of Mr.Limaye on whose peculiar submissions so many precautions were required to be taken by the Court in taking the consent terms on record, though in normal circumstance it was not warranted. The petition is already disposed of by the order dated 7 February 2018 in terms of the consent terms. Nothing further remains to be done.
