P.C.:- By an Order dated 7th March 2018, the Applicant was granted interim relief and was directed to report the Investigating Officer on the stipulated dates.
The learned APP, on instructions from PSI, Bakaygar who is present in the Court, submitted that charge-sheet qua other accused persons has already been filed before the Court of competent jurisdiction and the investigation qua the Applicant is completed. She further, on instructions, submitted that the custodial interrogation of the Applicant is not necessary.
Perused the record of investigation. The record indicates 1/2
ssm 2 8-aba429.18.sxw that the Applicant has attended the Investigating Officer on the stipulated dates and has joined the process of investigation. Apart from the recovery or taking the specimen signatures of the Applicant, the Applicant has cooperated in the process of investigation and the investigation in the present crime is practically completed. The custodial interrogation of the Applicant therefore, is not necessary. In view of the above, the interim order granted by this Court on 7th March 2018, is hereby confirmed. However, the condition to attend the Investigating Officer is waived. Application is allowed in the aforesaid terms. (A.S. GADKARI, J.) 2/2
