****** CORAM: R. D. DHANUKA AND ABHAY AHUJA, JJ.

DATE : 24th NOVEMBER, 2021.

P.C. :-

.

Considering the issue involved in the writ petition and in the Interim Applications it is not possible to hear either the Interim Applications or Writ Petition at this stage finally due to time constraint. 2.

We accordingly fix the hearing of the writ petition itself at 2:30 p.m. on 7th January, 2022, subject to the convenience of the Division Bench that would be assigned this matter, after reopening of the Court. 3.

It is made clear that if for any reasons the writ petition is not heard on the next, the applicant would be at liberty to press the Interim Applications inter-alia praying for revocation of the suspension. In that event, the respondents would be at liberty to oppose the Interim Application on its own merits.

4.

In view of this order, Mr. Sen, learned counsel for the applicant seeks liberty to withdraw Interim Application No. 49 of 2021, which even otherwise is overlapping with the Interim Application No. 3457 of 2021. Interim Application No.49 of 2021 is allowed to be withdrawn. 5.

Insofar as Interim Application No. 1482 of 2021 is concerned, the applicant (original respondent) seeks extension of time to conduct enquiry beyond three months originally granted in Interim Application No. 2640 of 2020, till the date of receipt of enquiry report and also for fixing an early date in Writ Petition. We have already fixed the hearing of the writ petition itself at 2:30 p.m. on 7th January, 2022. The said prayer is accordingly granted. Insofar as prayer for extension of time is concerned, learned counsel for both the parties agree that the enquiry is

already completed. If there is any delay in completing enquiry within the time granted by this Court in Interim Application No. 2640 of 2020, the time is extended in view of the fact that the merits of the showcause notice itself which is subject matter of the Writ Petition would be decided at the time of the hearing of the Writ Petition. 6.

Interim Application No. 1482 of 2021 is disposed of accordingly. 7.

Interim Application No. 1 of 2020, which is re-numbered as Interim Application No. 2640 of 2020 is also regarding extension of time. In view of earlier paragraph of this order, Interim Application No.2640 of 2020 is also disposed of. No order as to costs. [ABHAY AHUJA, J.] [R. D. DHANUKA, J.]
