This Miscellaneous Civil Application is under Section 24 of Code of Civil Procedure for transfer of Marriage Petition No.100 of 2014, pending in the Court of Civil Judge, Senior Division, Pune to Family Court, Mumbai where Matrimonial Petition No.56 of 2014 filed by the applicant is pending. The proceedings filed by the respondent for divorce is with allegations that the applicant suffers from mental disorder since birth and some problem relating to the brain. The very allegations made by the respondent in the petition for divorce justify transfer of the proceedings to Mumbai, where the applicant is residing. If the mental health of the applicant is not good, she cannot be made to undertake travel from Mumbai to Pune on every date of the matter.
Dusane 2/2 MCA107.2014 Hence, the Miscellaneous Civil Application is allowed in terms of prayer clause (a).
