Mr. Khadye, the learned Counsel for the petitioners, on instructions, seeks leave to withdraw the petition with liberty to approach the State Government and assail the impugned order dated 17th October, 2016, passed by the Additional Commissioner, Pune Division, Pune.

Leave granted with liberty as prayed for.

Mr. Khadye, however, submits that during the pendency of this petition, ad-interim order was passed on 31st October, 2018, in the nature of directing the Forest Circle Offcer, Pune, to postpone the proceedings/enquiry pending before him and the said order has been continued till date. 1/2

914-WP5783-17.DOC Mr. Khadye seeks said protection for some time to facilitate the fling of the proceedings before the State Government and seek appropriate interim relief in those proceedings. 3.

The statement is reasonable.

Thus, the petition stands dismissed as withdrawn with liberty as prayed for.

Ad-interim order passed by this Court on 31st October, 2018, in the nature of direction to the Forest Circle Offcer, Pune, to postpone the proceedings/enquiry pending before him, shall remain in operation till 30th November, 2019. 6.

All concerned to act on an authenticated copy of this order.
