Mr. Khamkar, learned counsel for the petitioner seeks leave to withdraw this Petition with liberty to file fresh application for transfer of the petitioner to Yerwada open prison, Pune, before Competent Authority. Leave with liberty as prayed for is granted. The Writ Petition is disposed of as withdrawn. 2.

In the event, the petitioner makes such application, the Competent Authority shall dispose of the same as expeditiously as possible and preferably within a period of four weeks from the date of receipt of such application.

It is expressly made clear that we have not gone into merits of the petitioner's claim and all points and contentions are kept open.
