Heard the learned counsel for the applicant.

This application is preferred by plaintiff for deleting the name of respondent no.5, Ramjanbhai Khokhar from the cause title of the First Appeal as well as pending Civil Application, if any.

The learned counsel for the applicant submits that respondent no.5 expired. Hence, they may be permitted to delete the name of respondent no.5. Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. a) Applicant is permitted to delete the name of respondent no.5 from the cause title of First Appeal as well as pending Civil Application at their cost and consequences.

b) Applicant to carry out appropriate amendment within four weeks from today and serve amended copy on the other side.

c) Civil application stands disposed off accordingly.
