In the facts and circumstances of the present case, a request is made to the trial Court to record the evidence of the child witness in terms of the mandate of section 35(1) of the Protection of Children from Sexual Offences Act, 2012 within a period of 3 months, if possible, from the date when this order is placed for its consideration.

Liberty to file a fresh bail application after 3 months or 1/2

The application is disposed of as withdrawn.

I appreciate the valuable assistance rendered by Advocate Ms.Payal Vardhan who appeared on behalf of respondent No.2 in this proceeding. Her engagement may be regularized by the Maharashtra State Legal Services Authority if she is on the panel or else she may be paid fees/ honorarium quantified at Rs.5000/-.
