DATED : 29 MARCH 2023 P.C. :- This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 33 of 2023 registered at Ambad Police Station for the offences punishable under Sections 3, 4, 5 and 7 of Prevention of Immoral Traffic Act. 3.

On 13 January 2023, raid was conducted at the premises of the present applicant and during the said raid the present applicant and other co-accused were found to be running brothel there. 4.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

I have perused the First Information Report. The main allegations are against the son of the present applicant. 6.

The learned APP submits that the applicant is involved in one more crime of similar nature. However, considering the fact that main allegations are against the son of the applicant, I am inclined to release the applicant on anticipatory bail on certain conditions. Hence, the following order is passed:

(i) Application is allowed.

(ii) In the event of arrest of applicant in Crime No. 33 of 2023 registered at Ambad Police Station for the offences punishable under Sections 3, 4, 5 and 7 of Prevention of Immoral Traffic Act, she shall be released on bail on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount subject to payment of Rs. 10,000/- to the victim.

(iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation. (iii) The applicant shall hand over the demand draft of the said amount to the Investigating Officer, who in turn shall hand over the said demand draft to the victim.
