Mr. Limaye, learned Counsel for the Petitioner having taken instructions from his client, who is present in the Court, seeks leave to withdraw the writ petition with liberty to file suit challenging the order impugned in this petition. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such. 2.

It is clarified that this Court has not gone into merits of the matter. All points and contentions of the respective parties are kept open. In the event the Petitioner files such a suit, the same shall be decided independently, on its own merits and strictly in accordance with law.
