1] By an Order dated 8h March 2018, the applicant was granted interim relief and was directed to attend the concerned Police Station on stipulated dates, to cooperate with the Investigating Agency. 2] Heard the learned counsel for the applicant and and the learned APP for the State. Perused the record of investigation. 3] The record of investigation indicates that, the applicant has acted as a estate agent in transaction of landed property between the first informant Shri Nana Darvade resident of Igatpuri, the purchaser. aba.445-2018.doc applicant has received commission for the said transaction. The ultimate beneficiary of the said transaction is the purchaser who got the immovable property as per the agreement of sale executed between the first informant and the purchaser to which the applicant is a witness. Apart from the said fact, prima facie there is no other role to play by the applicant in the present crime.
4] In view thereof, interim relief granted by an Order dated 8th March 2018 is hereby confirmed.
However, the condition to attend the concerned police station and/or Investigating Officer is waived.
