Heard. By this petition under Article 227 of the Constitution of India, the petitioner challenges order dated 08.12.2011 passed by respondent No.1 u/s.11 of the Maharashtra Ownership Flats (Regulation of the Promotion Construction, Sale, Management and Transfer) Act, 1963 granting deemed conveyance in favour of respondent No.4. 2.

It is the contention of the petitioner that the petition filed by the petitioner as a power of attorney of all the opponents in application No.42/2011. In the entire petition, nowhere it is stated that the same was filed through power of attorney. Therefore, on 04.07.2017 the matter was Basavraj G Patil 1/2

19.4000.14-wp adjourned by one week to enable the petitioner to take appropriate steps.

Today, the learned counsel for the petitioner seeks permission to withdraw the Writ Petition with liberty to file appropriate Writ Petition for the same cause of action by adding and/or joining appropriate parties. To that effect, he has given in writing. Same is taken on record and marked "X" for identification.

Writ Petition stands disposed of as withdrawn with liberty as prayed for.
