The application is moved for pre arrest bail as the applicant/accused is facing charges for the offences punishable under Sections 420 and 506(II) of the Indian Penal Code in C.R. No. 16 of 2016 registered with Bandra police station, Mumbai. The complaint is filed by one Wahid Abdul Jabbar Shaikh.

It is the case of the complainant that he has been occupying one room situated at Rajaram wadi, 97, Hill Road, Bandra(w), Mumbai since last 36 years as a tenant. In the month of January, 2014 he left his room to go to his native place at Bihar. At 1 / 3

that time, he wanted to keep one care taker of that room and that is why he keep the applicant/accused in the said room. In August, 2014 when the complainant returned from his native place, he asked the applicant to quit the room. So the applicant/accused left the room. However, the complainant found that in between the applicant/accused has transferred electricity bill in his name. Therefore, on 5th August, 2015 the complainant questioned the applicant/accused that why he transferred the electricity meter in his name, at that time, the applicant threatened him by his life. Then again on 29th December, 2015 the applicant/accused threatened him and told him to sign the papers and take Rs. 1,50,000/- for the said room or the applicant would shoot him. So he gave the complaint. 3.

The learned prosecutor opposed this application. 4.

On perusal of the application, I do not find any ground to reject the pre arrest bail to the applicant/accused. Hence, I pass the following order.

(a) In the event of arrest, the applicant/accused be enlarged on bail upon furnishing P. R. Bond in the sum of Rs. 2 / 3

15,000/- with one or two solvent sureties in the like amount; (b) The applicant shall not tamper with the evidence and not to harass the complainant in any manner. (c) The applicant shall cooperate with the Investigating Officer and shall attend Bandra police station, Mumbai on every Tuesday between 4.00 pm to 6.00 pm till filing of the charge-sheet.
