Learned counsel for applicant submits that, for grant of anticipatory bail in Crime No. 36/18 registered with Paud Police Station, Pune for the offence punishable under Section 302 r/w 34 of Indian Penal Code application is pending before the Trial Court. It is further submitted that in that application, applicant had prayed for interim protection wherein, learned Trial Court had issued notice and has not granted any such protection. Learned counsel thus submits that present application is filed for seeking interim protection to applicant till his application for anticipatory bail is considered by the Trial Court and for the purpose of present application has relied upon the order passed by Coordinate Bench of this Court in ABA No. 1/2
(911)aba-452-18 1866/2015 dated 14th December, 2015.

Considering the fact that application for anticipatory bail is pending before the learned Additional Sessions Judge, Pune and more particularly, as the interim application filed in said application has been made returnable after issuing notice to respondent without granting interim protection, no case is made out for granting interim relief pending the application before the Trial Court as aforesaid. 3.
In that view of the matter, no case is made out. Application is rejected and disposed of.
