The applicant came to be arrested in Crime No.537/2014 registered with Hadapsar Police Station for the offences punishable under Sections 302,143,147,148,149,201,352, 120-B of the Indian Penal Code and Section 3(1)(i),3(1)(ii),3(2), 3(4), 4 of the Maharashtra Control of Organized Crimes Act.

The learned counsel for the Applicant submits that the Applicant is in jail for more than 9 years and 8 months. It is submitted that the trial is not likely to be concluded within short span of time.

Learned A.P.P. submits that the present applicant is a gang Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

Inspite of order of this Court dated 30.03.2023 in Bail Application No.3675 of 2022 filed by the co-accused to conclude the trial as early as possible, it appears that for one reason or the other the trial Court could not conclude the trial. Considering the fact that the applicant is in jail for more than 9 years and 8 months, I am inclined to release him on bail.

ORDER

i.

Criminal Bail Application is allowed;

ii.

The applicant is directed to be released on bail in connection with Crime No.537/2014 registered with Hadapsar Police Station for the offences punishable under Sections 302,143,147,148,149,201,352, 120-B of the Indian Penal Code and Section 3(1)(i),3(1)(ii),3(2), 3(4), 4 of the Maharashtra Control of Organized Crimes Act, on executing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

iii.

The applicant shall attend the concerned police station once in a week, i.e., on Monday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial iv.

Application stands disposed of accordingly.
