P.C. :- 1] Mr. Niranjan Shimpi, learned counsel appearing for respondent Nos.2 and 3 (who claim to be owners in respect of the suit property), makes a statement that respondent Nos.2 and 3 will not sell, transfer, alienate or part with possession of the suit property pending the hearing and final disposal of the first appeal. This statement is accepted. In view of such statement, the civil application is disposed of.

2] Mr. Shimpi states that respondent No.1 was the original owner of the suit property and respondent Nos.2 and 3 have purchased the suit property by means of registered sale deed.
