This application is preferred under Section 438 of Code of Criminal Procedure. The applicant/accused is prosecuted for the offences of cheating and forgery along with 22 co-accused. One Madhukar Kashiram Wagh, a Government employee has registered the offence as there is forgery and cheating in respect of the scheme named Mahatma Gandhi National Rural Employment Scheme 2011.

The learned counsel for the applicant/accused has submitted that other accused having facing the similar allegations are given the protection by granting pre arrest bail by this Court and therefore seeks parity. The learned prosecutor also submits that the order passed by the Ombudsman, 1 / 2

906-aba-407-2015.doc Nashik initiating criminal prosecution against the present applicant has been set aside by the appellate authority on 16-12-2014. 3.

In view of this, though it is a first date, the order of granting pre arrest bail is passed on the lines of the earlier orders passed by this Court on 09-02-2015 and 23-12-2015.

Application is allowed. In the event of arrest, the applicant/accused be enlarged on bail on furnishing P. R. Bond in the sum of Rs. 15,000/- (Fifteen Thousand) with one or two solvent sureties in the like amount. 5.
