2) This application is preferred by the plaintiff for stay of the decree dated 1.8.2009 passed by the Appellate Court in Civil Appeal No.114 of 2009 and restraining the respondent No.1 from creating third party right/title/interest in respect of the suit property i.e. House No.41/VA/2/1/12 situated at CIDCO, Nashik.

3) Learned counsel Mr. Shetye appearing on behalf of respondent No.1 after taking instructions from his client makes a statement that respondent No.1 do not

want to create any thirty party right/title/interest in respect of the suit property till the hearing and final disposal of the second appeal. Statement is accepted. 4) In view of the statement made by the learned counsel for respondent No.1 nothing survives in the present civil application. Hence, same stands dismissed as infructuous.
