Heard the learned counsel for the parties.

By this petition under Article 227 of the Constitution of India, the Petitioner challenges the order dated 21.1.2016 passed by Labour Court, Satara below Exhibit C-4.

The learned counsel for the respondent submits that the present Writ Petition is filed against wrong person. He submits that the respondent is not party in application (IDA) No.9 of 2015. Hence, the petition is required to be dismissed on this ground only.

At this stage, the learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file afresh for same cause of Mohite 1/2

To that effect, he has given in writing on Farad. Same is taken on record and marked "X" for its identification.

Writ Petition stands disposed of as withdrawn with liberty to file afresh for same cause of action.
