The above Miscellaneous Civil Application is filed under Section 24 of the Civil Procedure Code seeking transfer of Hindu Marriage Petition No.1198 of 2016 from the Court of 2 nd Joint Civil Judge, Senior Division at Kalyan to the Family Court at Pune.

Both the parties are Doctors. The Respondent-husband is attached to the Municipal Hospital at Bhandup and the Applicant-wife is attached to the Civil Hospital at Pune. Since the transfer of proceedings shall also cause inconvenience to the Respondent-husband, parties through their Advocates have agreed to conduct the proceedings through video conferencing. In view thereof, following order is passed by consent.

(i) The parties and the 2 nd Joint Civil Judge, Senior Division at

kpd 2 / 2 5-MCA-177-2017.sxw Kalyan shall conduct the proceedings pertaining Hindu Marriage Petition No.1198 of 2016 filed by the Respondent-husband through video conferencing. (ii) If the Court of 2 nd Joint Civil Judge, Senior Division at Kalyan is not equipped to conduct the proceedings through video conferencing, the Respondent-husband shall provide laptop, WIFI and other equipments necessary to conduct the proceedings through video conferencing. (iii) The 2 nd Joint Civil Judge, Senior Division at Kalyan shall allow the Applicant-wife to file her written statement on or before 24.08.2017 and shall forward a copy of the written statement to the Respondent and/or his Advocate. (iv) The 2 nd Joint Civil Judge, Senior Division at Kalyan shall not grant adjournments to either party unless absolutely necessary and shall endevour to dispose off the Hindu Marriage Petition No.1198 of 2016 within a period of six months from the date of this Order.

(v) All contentions of the parties are kept open. 3.

The above Miscellaneous Civil Application is accordingly disposed off. ( S.J.KATHAWALLA, J. )
