Heard learned counsel for the parties.

By Civil Application, the Applicant ­ Insurance Company is seeking condonation of 26 days delay in filing the First Appeal challenging the Judgment and Award dated 02 July, 2016 passed by the Motor Accident Claims Tribunal Baramati, in Motor Accident Claim Petition no. 237 of 2009. 3.

Considering the submissions made by learned counsel for the Applicant and the averments in Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application. 1/2

a) Delay in filing First Appeal, is condoned.
