DATED : 22 FEBRUARY 2023 P.C. :- This is an application under Section 439 of the Code of Criminal Procedure, 1973 for bail.

The applicant came to be arrested in Crime No. 3 of 2019 registered at Upnagar Police Station, Nashik for the offences punishable under Sections 20(b)(ii) and 22(c)(ii) of the Narcotic Drugs and Psychotropic Substances Act (NDPS).

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

On the basis of secrete information, on 1 January 2019, a raid was conducted at the premises of the applicant and he was found in possession MJ Jadhav 1 / 2

49-BA-970-22.odt of 2553 grams of Ganja, which is intermediate quantity. 5.

The applicant is in jail for more than four years. The trial has not yet commenced.

The learned APP submits that the applicant is involved in eight more crimes. However, they are not for the offences under the NDPS Act. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. Hence, the following order is passed: (i) Application is allowed.

(ii) The applicant shall be released on bail in Crime No. 3 of 2019 registered at Upnagar Police Station, Nashik for the offences punishable under Sections 20(b)(ii), 22(c)(ii) of the Narcotic Drugs and Psychotropic Substances Act (NDPS) on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

(iii) The applicant shall not enter into the limits of Upnagar Police Station, Nashik till conclusion of trial.

(iii) The applicant shall attend the concerned police station within whose jurisdiction he is going to reside after his release once in a month i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial. ( N.R. BORKAR, J. ) MJ Jadhav 2 / 2
