The above Civil Application is filed seeking a stay of the impugned judgment and decree dated 7th June, 2017. By the impugned judgment the petition filed by the Applicant seeking restitution of conjugal rights was dismissed.

The learned advocate appearing on behalf of the Applicant fairly stated that there cannot be a stay after the dismissal of the petition. She, therefore, sought leave to withdraw the above Civil Application.

In these circumstances, the Civil Application is dismissed as withdrawn. However, there shall be no order as to costs. 4.
