This is an application seeking condonatin of delay in filing an application seeking leave to appeal challenging the judgment and order passed by Metropolitan Magistrate, 43rd Court, Borivali, Mumbai in C.C. No.872/SS/2012 dated 16.11.2015thereby acquiting the accused of the offence punishable under Section 138 read with Section 141 of Negotiable Instruyments Act. There is delay of 2 days. 2.

For the reasons assigned in paragraphs 3, 4 and 5, the delay of 2 days deserves to be condoned in the interest of justice. Hence, the application is allowed in terms of prayer clause (a). Application stands disposed of.
