This Writ Petition challenges an order passed by the Labour Court at Mumbai on an application for restoration filed by the Respondent herein (Original first party). By the impugned order, the ex-parte award passed in the reference was set aside and the reference was restored on file.

After the matter is heard at some legnth, it is agreed between learned Counsel for both parties that the petition may be disposed of by directing the Labour Court at Mumbai to dispose of the reference expeditiously and in a time bound manner. 4.

The Writ Petition is accordingly disposed of by directing the Labour Court at Mumbai to dispose of reference (IDA) No. 268 Laxmi Pg 1 of 2

23 WP 8580-18.odt of 2008 as expeditiously as possible and in any event, within a period of six months from the date this order is pointed out to the Court. Both parties may appear before the Labour Court on 17th January, 2020, when either party may produce an authenticated copy of this order. The Labour Court may thereupon fix a schedule of hearings and dispose of the reference in accordance with this order. All rights and contentions of the parties on merits are kept open.
