Heard. This Application is preferred by the Defendant for stay of the operation and implementation of the impugned decree dated 29/12/2012 passed by the Civil Judge, Senior Division Baramati in Special Civil Suit No. 88/2006.

In the present proceedings, this court (Coram : S. V. Gangapurwala, J.) passed an order dated 12/08/2013 granting ad-interim stay to the impugned order and restraining the Appellant Defendant from creating any third party right, title and interest in respect of the suit property. By consent of the parties, Civil Application stands disposed of in following terms:

a.

Ad-interim relief granted by this court (Coram : S. V. Gangapurwala, J.) on 12/08/2013 to continue till hearing and final disposal of the First Appeal.

b.

Liberty granted to the Respondent Plaintiff to prefer an appropriate Application for monthly compensation, if they so desire, which will be decided on its own merits.

c.

Civil Application stands disposed off accordingly.
