The Petitioner is essentially seeking action of demolition in respect of construction carried out in the property bearing CTS No. 192/5 situated at Sai Baba Temple, near Pandurang Niwas Pada No. 2, Balkum Thane (W).

Having perused the Petition, we find that the Petition lacks material particulars in respect of the nature of the alleged illegal and unauthorised construction.

We, therefore, dispose of the Writ Petition by permitting the Petitioner to make a Representation to the Respondent-Corporation. If such Representation shall be made by the Petitioner within three weeks from today, the same shall be decided by the Assistant Commissioner and Competent Authority of the RespondentCorporation expeditiously. 4.

Needless to state that if the constructions are found to be illegal and unauthorised, appropriate action including that of removal/ demolition shall be taken by the Respondent-Corporation in accordance with law.
