1) Present application was filed in March 2016. The learned APP, upon instructions from the Investigating Officer, makes a statement that trial in Sessions Case No. 218 of 2015 has commenced and two witnesses are examined. The charge framed against the Applicant is under Section 302, 201, 504, 506 of the Indian Penal Code. Since, the trial has commenced, there is no question of considering the application under Section 439 of the Code of Criminal Procedure, 1973.
